Legislative Recovery Fee

In 2003 Congress enacted a new law aimed at prevention and help for victims of identity theft.

The Fair and Accurate Credit Transaction Act of 2003 (FACTA) added new sections to the federal Fair Credit Reporting Act (FCRA, 15 U.S.C. 1681 et seq.), intended primarily to help consumers fight the growing crime of identity theft. Accuracy, privacy, limits on information sharing, and new consumer rights to disclosure are included in FACTA.

The new provision of this law went into effect June 1, 2005. The act allows consumers to request and obtain a free credit report once every twelve months from each of the three nationwide consumer credit reporting companies

To help defray the cost of developing and maintaining a system that permits consumers to obtain their free annual credit report the bureaus (Trans Union, Experian and Equifax) have imposed a surcharge on all credit reports issued.

This surcharge however, jeopardizes our ability to provide exceptional customer service and it has become necessary to include a “legislative recovery fee” on your monthly billing beginning January 1, 2008.
